{"id":8409,"date":"2025-09-01T13:40:04","date_gmt":"2025-09-01T10:40:04","guid":{"rendered":"https:\/\/esghub.ro\/?p=8409"},"modified":"2025-09-01T13:42:48","modified_gmt":"2025-09-01T10:42:48","slug":"eu-regulation-on-forced-labour","status":"publish","type":"post","link":"https:\/\/esghub.ro\/en\/regulamentul-eu-privind-munca-fortata\/","title":{"rendered":"EU regulation on forced labour"},"content":{"rendered":"<h2 data-start=\"0\" data-end=\"461\">Definition of forced labour<\/h2>\n<p data-start=\"0\" data-end=\"461\">The European Union Regulation on forced labour, adopted in 2024, establishes a ban whereby no product made using forced labour may be placed on the European market, regardless of whether it is manufactured inside or outside the Union. The regulation uses the definition of the International Labour Organisation, which considers forced labour to be any activity required of a person under threat of punishment and to which they have not voluntarily submitted.<\/p>\n<h2 data-start=\"0\" data-end=\"461\">Calendar, responsibilities, procedure<\/h2>\n<p data-start=\"463\" data-end=\"995\">The regulation was published in the Official Journal in December 2024, but the ban will not actually come into force until December 2027. There are several intermediate stages until then. Member States must designate the responsible authorities by the end of 2025, and the European Commission is to publish a database of areas, sectors and products considered high-risk, together with implementation guidelines, in June 2026. The first assessment of how the regulation is working is scheduled for December 2029.<\/p>\n<p data-start=\"997\" data-end=\"1539\">Enforcement depends on two levels of authority. Cases within the Union will be handled by national institutions designated by each Member State, while situations involving supply chains outside the Union will be coordinated by the European Commission. Investigations will be conducted on a risk basis. If there are suspicions, companies will be required to provide additional information, and in the most serious cases, bans, market withdrawals and even the destruction of the products concerned may be ordered.<\/p>\n<p data-start=\"1541\" data-end=\"1817\">To support implementation, the Union will establish a coordination network between Member States, a single portal for reporting suspicions, and tools dedicated to SMEs. All of these aim to ensure uniform and transparent implementation.<\/p>\n<h2 data-start=\"1541\" data-end=\"1817\">Connection with CSDDD and Omnibus<\/h2>\n<p data-start=\"1819\" data-end=\"2645\">The Forced Labour Regulation is linked to the Corporate Due Diligence Directive (CSDDD) in that the latter requires large companies to identify and mitigate risks of abuse in their supply chains. This directive is currently being influenced by two Omnibus legislative packages. The first provides for changes to the content that could reduce companies' monitoring obligations. The second package (stop the clock) postpones the deadlines for implementation. These changes do not directly affect the regulation on forced labour, but they could create a paradoxical situation: the ban will become applicable in 2027, while the directives that should provide companies with a more detailed framework for verification could be relaxed or delayed. Until then, regardless of developments related to Omnibus and CSDDD, the ban on products obtained through forced labour will be implemented according to the established timetable (December 2027).
